Terms and Conditions

Welcome to Authors Publishing House (“APH”). These Terms of Business (“Terms”) govern your access to and use of our services, products, and any related interactions with APH. By engaging in any business with APH, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our services or products.

  1. Definitions
  • Client: The individual or entity that engages APH for services.
  • Services: The services provided by APH, including but not limited to publishing, editing, marketing, and consulting.
  • Products: Any tangible or digital products provided by APH.
  1. Scope of Services

APH will provide the services and products as agreed upon in a separate agreement or invoice. The scope of services will be clearly outlined, and any changes or additions will require mutual agreement.

  1. Fees and Payment
  • Pricing: Fees for services and products will be outlined in the agreement or invoice. Prices are subject to change with prior notice.
  • Payment Terms: Payment is due upon receipt of the invoice unless otherwise agreed upon. Payment methods accepted include credit cards, bank transfers, and other methods as specified.
  • Late Payments: Late payments may incur interest at a rate of 1.5% per month or the highest rate permitted by law, whichever is lower.
  1. Cancellation and Refund Policy
  • Cancellation: Clients may cancel services with written notice. The cancellation policy and any applicable fees will be outlined in the agreement.
  • Refunds: Refunds for products and services are subject to the terms outlined in the agreement. Custom and digital products are generally non-refundable.
  1. Client Responsibilities

Clients agree to provide all necessary information, materials, and cooperation required for APH to perform the services. Delays caused by the Client may affect delivery timelines and may result in additional fees.

  1. Intellectual Property
  • Ownership: The Client retains ownership of all intellectual property rights to the materials provided to APH. APH retains ownership of any materials created by APH until full payment is received.
  • License: The Client grants APH a limited, non-exclusive license to use the materials provided by the Client for the purpose of providing the services.
  1. Confidentiality

Both parties agree to keep confidential all information that is disclosed during the course of the business relationship. This obligation remains in effect even after the termination of services.

  1. Limitation of Liability

APH’s liability is limited to the amount paid by the Client for the services or products. APH is not liable for any indirect, incidental, or consequential damages.

  1. Indemnification

The Client agrees to indemnify and hold APH harmless from any claims, damages, losses, or expenses arising out of or related to the Client’s use of the services or products.

  1. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms will be resolved through mediation or arbitration in New York.

  1. Amendments

APH reserves the right to amend these Terms at any time. Any changes will be communicated to the Client and will become effective upon such communication.

  1. Entire Agreement

These Terms, along with any agreements, invoices, and additional terms referenced herein, constitute the entire agreement between the parties and supersede all prior agreements and understandings.
